Terms of Service

1. Acceptance of Terms

By accessing or using the TaitaAI platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. TaitaAI reserves the right to modify these Terms at any time, with changes effective upon posting.

2. Account Registration and Phone Verification

To use the Service, you must complete account registration including mobile phone verification via our Telnyx Sybil Shield system. This verification requires:

• A valid physical SIM-based mobile phone number (VOIP and virtual numbers are not permitted)
• Completion of carrier hardware attestation protocol
• One account per verified device identity

You are responsible for maintaining the confidentiality of your account credentials. You agree to immediately notify TaitaAI of any unauthorized use of your account.

3. Credit System and Billing

The Service operates on a credit-based system. Credits are allocated monthly based on your subscription tier and do not roll over between billing cycles unless otherwise specified. Unused credits expire at the end of each billing period.

• Subscription fees are billed in advance on a monthly or annual basis
• All fees are non-refundable except as required by applicable law
• TaitaAI reserves the right to modify pricing with 30 days advance notice
• Exceeding credit limits will pause generation until the next billing cycle

4. Acceptable Use

You agree not to use the Service to:

• Generate content that impersonates real individuals without their explicit consent
• Create deepfake content intended to deceive, defraud, or harm others
• Produce content that violates any applicable law, including intellectual property rights
• Generate content depicting minors in any inappropriate context
• Circumvent the phone verification system or create multiple accounts
• Reverse-engineer, decompile, or attempt to extract source code from the Service
• Use automated means to access the Service beyond authorized API endpoints
• Distribute malware, spam, or any content that disrupts the Service

5. Content Ownership and Licensing

Content generated through the Service ("Generated Content") is owned by you, subject to the following conditions:

• You retain ownership of all input materials you provide to the Service
• Generated Content is licensed to you for commercial use according to your subscription tier
• TaitaAI retains a non-exclusive license to use anonymized generation data for model improvement
• You are solely responsible for ensuring Generated Content does not infringe third-party rights

6. Persona Vault Data

The Persona Vault stores behavioral linguistic profiles derived from your input data. You retain ownership of your Persona Vault data. Upon account termination, Persona Vault data will be permanently deleted within 30 days unless legally required to retain it.

7. Service Availability

TaitaAI strives to maintain 99.9% uptime but does not guarantee uninterrupted service. Scheduled maintenance windows will be communicated in advance. TaitaAI is not liable for any damages resulting from service interruptions, including lost credits during downtime periods.

8. Termination

TaitaAI may suspend or terminate your account at any time for violation of these Terms. Upon termination:

• All unused credits are forfeited
• Access to Generated Content stored on our servers will be revoked
• Persona Vault data will be queued for deletion
• You remain responsible for any outstanding billing obligations

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAITAAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

TaitaAI's total liability shall not exceed the amount paid by you to TaitaAI in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless TaitaAI, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable international commercial law. Any disputes arising under these Terms shall be resolved through binding arbitration.
