1. Overview

TaitaAI respects the intellectual property rights of others and expects its users to do the same. This Digital Millennium Copyright Act (DMCA) Policy outlines the procedures for reporting copyright infringement on our AI content generation platform, including AI-generated content that may infringe upon copyrighted works.

2. Unique Considerations for AI-Generated Content

TaitaAI generates content using artificial intelligence models. While our systems are designed to create original content, there may be instances where AI-generated outputs inadvertently resemble or incorporate elements of copyrighted material. We take all infringement claims seriously regardless of whether the content was created by AI or uploaded by a user.

3. Filing a DMCA Takedown Notice

If you believe that content available through the TaitaAI platform infringes your copyright, you may submit a DMCA takedown notice. Your notice must include:

1. A physical or electronic signature of the copyright owner or authorized agent
2. Identification of the copyrighted work(s) claimed to have been infringed
3. Identification of the infringing material and information sufficient to locate it on our platform (e.g., URLs, account identifiers, content IDs)
4. Your contact information, including name, address, telephone number, and email address
5. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
6. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf

4. Processing of Takedown Notices

Upon receipt of a valid DMCA takedown notice, TaitaAI will:

• Acknowledge receipt within 24 hours
• Remove or disable access to the allegedly infringing content promptly
• Notify the user who created or published the content of the takedown
• Provide the user with a copy of the notice and information about filing a counter-notification

5. Counter-Notification

If you believe your content was removed in error, you may file a counter-notification containing:

1. Your physical or electronic signature
2. Identification of the material that was removed and the location at which it appeared before removal
3. A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification
4. Your name, address, telephone number, and a statement that you consent to the jurisdiction of the federal court in your district and will accept service of process from the complainant

Upon receipt of a valid counter-notification, TaitaAI will forward it to the original complainant and restore the material within 10-14 business days unless the complainant files a court action.

6. Repeat Infringer Policy

TaitaAI maintains a strict repeat infringer policy. Accounts that receive:

• First notice: Warning issued, content removed
• Second notice: Account suspended for 30 days, content removed
• Third notice: Account permanently terminated, all content deleted

TaitaAI reserves the right to terminate any account at any time for egregious or willful infringement, regardless of the number of prior notices.

7. AI Model Training Data

TaitaAI uses third-party AI models for content generation. Claims regarding the training data of underlying AI models should be directed to the respective model providers (Fal.ai, ElevenLabs, Sync Labs). TaitaAI is responsible only for content generated through and hosted on our platform.

8. Good Faith Requirement

Filing a false DMCA notice or counter-notification may result in liability for damages, including costs and attorneys' fees. Please ensure that you have a good faith belief that the material in question is infringing before submitting a notice.

9. Persona Vault and Voice DNA Claims

If you believe that a TaitaAI user has created a Persona Vault profile that impersonates your voice, writing style, or public persona without authorization, you may file a specialized identity infringement claim. These claims are processed under our Acceptable Use Policy in addition to standard DMCA procedures.
